Climate change has established itself as one of the most pressing problems of our time. Inevitably, differences have arisen. How to solve them? Elements of response with the president of the Mauritian branch of the Association of International Law.
What are the main areas that were discussed at the round table organized on June 20 jointly by the International Law Association and the United Nations Commission on International Trade Law?
The key points of our discussion on the role of mediation in climate change and sustainability disputes include several aspects. We addressed the issue of mediation, which offers a constructive and collaborative approach to resolving climate change conflicts.
We also highlighted the advantages of mediation, including strengthening communication, seeking mutually beneficial agreements, and promoting sustainable results. In addition, during this round table, the Singapore Convention on Mediation was mentioned as a useful framework for resolving international climate-related disputes. It is necessary to promote awareness and adoption of the Singapore Convention.
Personally, I am of the opinion that mediation should be integrated into climate change policies and decision-making. Collaborative approaches and partnerships between governments, international organizations, civil society and private sector actors are crucial to using mediation and the Singapore Convention. This will help meet the challenges posed by climate change and sustainability.
How is that?
Mediation can offer a constructive and collaborative approach to resolving climate change conflicts by facilitating dialogue between the parties concerned. It can also help identify common interests by encouraging negotiation for solutions that benefit all.
What are the advantages of mediation?
The advantages are multiple. It offers flexibility, confidentiality, control of the parties over the result and the possibility of maintaining positive relationships. In addition, it is faster and less expensive than other forms of conflict resolution.

We would like to express our gratitude to Catherine Kessedjian for inviting him and Diana Paraguacuto-Maheo to co-chair the debates. The Mauritius International Law Association organized a webinar on October 22, 2020. It is with the aim of explaining the role and function of the Permanent Court of Arbitration. The president of the association, lawyer Steven Sengayen, returned to the subject in an interview with Défi Plus. He discussed various cases heard before this body and explained its importance. He also added that a decision before the Permanent Court of Arbitration (PCA) binds the parties and that there is no appeal mechanism, according to the PCA arbitration rules.

The goal of the webinar is to improve understanding of the PCA, which was established in 1899 and also to facilitate arbitration and other forms of dispute resolution between states.
The headquarters of the CPA was built in 1913 and is located in The Hague, the Netherlands. It is known as a "Peace Palace".
Mauritius is the only country in the region and in Africa that has a legal framework on international arbitration. This appeal raises questions about the acquisition of ownership of immovable property through acquisitive prescription and the loss of a right of action through extinctive prescription.
The principal issues in this appeal are (i) whether the appellant’s authors had possession of the Plot of the necessary quality to entitle Lekha Kawal to become its owner by acquisitive prescription and (ii) whether the appellant’s action is time-barred by extinctive prescription. The Board will also address the challenge that the appellant failed to make his siblings parties to the action.

D’origine mauricienne, Steven Sengayen est un homme de loi établi en Angleterre. Il n’a pas pour autant oublié son île natale. Pour preuve : il se lance dans un projet qui permettra à nos juges, avocats, notaires et autres avoués de se joindre à une association présente dans 62 pays. Il s’agit du lancement d’une branche de l’International Law Association.
Steven Sengayen a été mandaté par le siège social de l’association à lancer cette branche mauricienne. Lors d’une visite à Maurice, la semaine dernière, il nous a expliqué les objectifs de ce projet, approuvé par l’Attorney General, Maneesh Gobin.

Qu’est-ce que l’érosion de la base d’imposition et le transfert de bénéfices connus comme le Base Erosion and Profit Shifting (BEPS) ?
Le BEPS est un projet pour trouver des solutions dans certains pays afin de les aider à réduire la déduction des sommes qui érodent l'assiette fiscale ou simplement en transférant les bénéfices dans des juridictions fiscales inférieures. Ces pratiques sont adoptées par certaines entreprises multinationales. Cela dit, le BEPS fait référence à des stratégies d'évasion fiscale qui exploitent les lacunes sur le transfert des bénéfices vers des juridictions fiscales à faible ou sans impôt.......

On dit que le Comité judiciaire du Conseil privé (CJCP) de la reine d’Angleterre est une juridiction de dernier recours à Maurice. On peut se demander ce qu’est le CJCP de la reine d’Angleterre, car sa présence dans l’organigramme judiciaire est parfois mal comprise.
Le recours fut possible dès 1810 lorsque l’ile Maurice devint colonie britannique. Quand le pays accéda à l’Independence en 1968, le législateur mauricien décida de promulguer The Mauritius
